Philippines is committed to pursue peaceful means to resolve disputes through UN arbitration against China’s nine-dash line claim.
Claimants in the Asia-Pacific region must contemplate the establishment of closer ties among their naval forces, while exploring potential avenues for closer, institutionalized intelligence-sharing and defense cooperation. Cooperation among claimants could start on gradual basis that would send a strong signal to China that the ASEAN can’t be divided on a bilateral basis.
It is also important that the claimant states coordinate and institutionalize their strategic network of defense cooperation with great powers such as the US and Japan; they need to develop a common approach to soliciting greater defense support from Japan and the US Joint-exercises and regularized defense, foreign ministry and track exchanges among Vietnam, the Philippines, Japan, and the US should be considered. Enhanced exchanges among these countries would bring about common understanding of China’s strategic intention to the South China Sea, thus, helping formulate a strategy to negate China’s provocation. The Philippines confirmed on Monday, June 9, that Indonesia has proposed a special meeting among foreign ministers of the Association of Southeast Asian Nations (ASEAN) to discuss rising tensions in the disputed South China Sea. The special meeting proposed by Indonesia is expected to ‘send a strong signal to China’. Based on CCP‘s reality following international news events, China has been behaving lately like an international outlaw with expansion agenda: (1) the moving an oil rig at Vietnam’s EEZ, (2) illegal poaching by Chinese fishermen in Philippine territory and (3) building military bases at the Philippine’s own Mabini (Johnson), Malvar, Gaven, Hughes and Cuarteron reefs in Spratly islands.
I believe that regardless of a favorable outcome of the Philippine’s memorial submission to ITLOS, China will still use threats of force, intimidation, coercion and gunboat diplomacy because China will disregard the arbitration outcome and a tribunal can’t stop China from bullying its neighbors posing a complicated challenge to the region’s peace and security unless a necessary boost in military hardware upgrade capability in the Philippines is attained together with a US asia-pacific alliance, sanctions and a strong international support to militarily confront or deter China’s armed invasion collectively thereby upholding the rule of international law, unimpeded trade and freedom of navigation. Philippine losing territory
China’s land reclamation on reefs in the West Philippine Sea is its way of asserting its claim to almost the entire South China Sea that no other country recognizes, a Filipino security expert said on Saturday.
Jose Antonio Custodio, a security expert and military historian, also warned that the Philippines was already losing its territory to the Chinese.
With the reclamation of land on various reefs in the Spratly Islands, the Chinese are “expanding,” Custodio told the Inquirer in a phone interview.
“De facto, they are practically occupying areas that we claim … and strengthening the nine-dash line,” Custodio said, referring to China’s demarcation on official maps of its claim over 90 percent of the 3.5-million-square-kilometer South China Sea.
China, Custodio said, is establishing a chain of occupied territories in the West Philippine Sea, “cutting off the garrisons, hoping that we ourselves would pull out, finding it unsustainable to keep our garrisons there.”
Taking note of the geopolitical issues in the Asia-Pacific region as well, Custodio said China may be eyeing two results with the strategy: frustrating the Philippines’ territorial claims as the “short-term” goal and denying the United States of movement in the region as the “long-term” objective.
For Custodio, the Philippines should start strengthening its Coast Guard to protect its seas since the Chinese are deploying their own Coast Guard vessels there.
Custodio said that while the Philippines was “setting the moral high ground” by following the informal code of conduct among Spratly claimants, it is gradually losing parts of its territory.
Custodio was referring to the 2002 Declaration of Conduct of Parties in the South China Sea, a nonbinding agreement with the Association of Southeast Asian Nations (Asean) to keep the status quo in the disputed waters.
“The Chinese are not following the code of conduct, we’re the only ones following [it],” Custodio said.

China’s invasion and occupation of Mischief Reef in 1995 and Scarborough Shoal in 2012 are acts of armed aggression against the Philippines that violate the United Nations Charter, Supreme Court Senior Associate Justice Antonio Carpio said Friday.
Carpio, in a speech before the Philippine Women’s Judges Association at De La Salle University, said China is also threatening to forcibly evict Philippine Marines aboard the shipwrecked RPS Sierra Madre in Ayungin Reef within the Philippines’ exclusive economic zone (EEZ) in the Spratlys.
The Philippines is not the lone target of China, according to Carpio. He said Beijing also committed armed aggression against Vietnam in the Paracels in 1974 and Fiery Reef Cross in 1988.
“The world is now familiar with the expansionist designs of China in the South China Sea. China’s creeping invasion of the islands, rocks and reefs, as well as of the waters, of the South China Sea grows in force and aggressiveness each day as China’s naval forces assume greater superiority over those of other coastal states,” he said.
Carpio said China is using force and is making up historical falsehoods because its position is weak under international law.
“China’s claim of sovereignty over South China Sea is an egregious lie, inconsistent with historical facts and its own pronouncements,” he said.
Carpio said that under international law, historical information is irrelevant in the settlement of maritime disputes. “Yet, China insists without basis,” he said.
“Even if we indulge China in its claims, historical facts, ancient maps, and former Chinese constitutions disprove China’s 9-dash claim,” Carpio said. See China’s invasion is armed aggression

May 17, 2014: “By supporting our Vietnamese neighbors, we are showing that we are all one on the issue of China’s aggression in the region and illegal usurpation of Paracel islands in the South China Sea,” said Loida Nicolas Lewis, chair of the US Pinoys for Good Governance.
“We object in the strongest possible terms China’s deployment last week of a deep sea oil rig known as HD-981 within Vietnam’s continental shelf. We therefore express solidarity with the Philippines against Chinese aggression in defiance of international law and UNCLOS (UN Convention on the Law of the Sea),” said Hoi Trinh of Philippine-based group Vietnamese Overseas Initiative for Conscience Empowerment (VOICE).
Rogelio Santos of Filipinos Unite added China’s installation of an oil rig in Vietnamese territory is a wake-up call to the international community.
“It clearly shows that China’s intentions, willingness and capability to illegitimately occupy and extract the resources of other nations in blatant defiance of international law are very real,” he said.
Santos said the setting up of the oil rig in the disputed waters sets the stage for how the international community must respond.
“This is why we, as Filipinos, stand against China’s actions together with our Vietnamese brothers and sisters – for they are now where we could have been and where we could be if we don’t nip these actions in the bud,” he added.
The militant Pambansang Lakas ng Kilusang Mamamalakaya ng Pilipinas (Pamalakaya) assailed Beijing over the reclamation of land in Mabini Reef, saying China clearly violated the Philippine sovereignty based on “foul, false and ridiculous claim.”
Pamalakaya vice chairman Salvador France said the reclamation activity aimed at building an airstrip or an offshore military base is not only a provocative act but also a direct assault on Philippine sovereignty and territorial integrity. China and the 10-member Association of South East Asian Nations (ASEAN) signed an agreement in 2002 to refrain from occupying uninhabited reefs and shoals in the sea, and from building new structures that would complicate disputes.

US Asia-Pacific Alliance vs China
May 25, 2014: Amid a warning from China against military alliances in the region, the United States is working out a new “security architecture” in the Asia-Pacific with its strategic partners and treaty allies including the Philippines, official sources said.
The new security arrangement is being forged as regional tensions rise over China’s increasingly aggressive moves to stake its territorial claim over waters around it, including nearly the entire South China Sea.
New US bases, considered too expensive by Washington, are out, according to the sources. Instead, the United States will be working with “spokes” in the new security architecture as part of the pivot or rebalancing of US forces in the region.
The sources told The STAR that aside from the Philippines, the “spokes” would include Australia and Japan, and possibly Singapore and Thailand. Washington is also wooing Malaysia as a strategic partner.
Chinese president Xi Jin Ping issued the warning as Japan, the Philippines and Vietnam find common cause against aggressive Chinese moves to stake its territorial claim in the East China Sea and the so-called Nine-Dash Line in the South China Sea.
At the WEF session, US Admiral Locklear described the Nine-Dash Line as “rather ambiguous” as he called for a “baseline” and maintenance of the status quo in disputed waters.
He also said a “winner-take-all” attitude could not work in the region. The United States is thus likely to find its system of alliances and partnerships in Asia an increasing source of contention with China. Senior U.S. policy makers have made clear that the United States has legitimate and important strategic interests in Asia. Moreover, the United States retains considerable strength as the dominant power in the region, even if some of its relative advantages have declined in recent years. The U.S. has reiterated the strategic value of its alliances and the importance of the interests of its allies. This leaves China, the United States, and its allies with increasingly complex and difficult decisions. Reassuring Beijing requires the U.S. to either weaken or redefine its alliance system to accommodate China’s security preferences. This could prove dangerously destabilizing as vulnerable countries realize they must take action to defend their interests. It would also mean a significant weakening of influence in a region of the world that is of vital strategic importance to the future of the U.S. economy. However, reassuring allies requires a greater U.S. willingness to confront China in sovereignty disputes and other issues. This risks deterioration in U.S.-China relations and potential destabilization of the regional order. China and the United States and its allies will need creative policy making to balance these competing concerns and ensuring lasting peace and stability in the region. It has developed strategic understanding with Vietnam and expanded economic and defence ties. State-run explorer Oil and Natural Gas Corp. (ONGC) has a stake in a gas field in the Nam Con Son basin, off Vietnam’s south coast. Days after India and Vietnam agreed to additional presence by state-run ONGC in oil blocks in South China Sea, Beijing decided to set up oil rig to reinforce its territorial claims in the region. This surprised India as Chinese move came after ONGC decided to increase its presence in Vietnam. India has already five exploration blocs by its ONGC Videsh (OVL). President Barack Obama on Wednesday criticized the US Senate for its continued failure to ratify the Law of the Sea Convention, saying “we cannot exempt ourselves from the rules that apply to everyone.”
“It’s a lot harder to call on China to resolve its maritime disputes under the Law of the Sea Convention when the United States Senate has refused to ratify it – despite the repeated insistence of our top military leaders that the treaty advances our national security,” Obama said in a commencement address to graduates at the US Military Academy in West Point, New York. China will grow in presence and strength in the hotly contested East China and South China Seas in the next years as it increases patrol capabilities to assert its maritime claims, the Pentagon said.
In its report to the United States Congress released last week, the US Department of Defense (DoD) said that China Coast Guard’s total force is expected to increase by 25 percent as Beijing presses its sovereignty in areas claimed in part by the Philippines.
“China identifies its territorial sovereignty as a core interest and emphasizes its willingness to protect against actions that China perceives challenge Chinese sovereignty,” Defense Secretary Chuck Hagel’s office said.
“In the next decade, a new force of civilian maritime ships will afford China the capability to patrol its territorial claims more robustly in the East China and the South China Sea,” the report added.
Beijing is keen on showing the world its military capabilities while trying to convince its neighbors and the US that it is rising peacefully.

This week a communiqué was issued in Brussels by the Group of 7 (Canada, France, Germany, Italy, Japan, US, United Kingdom) and the European Union declaring support for the right of territorial and maritime claimants to seek peaceful resolution of disputes in accordance with international law, including “legal dispute settlement mechanisms.” Inversely, the G-7 opposes any unilateral attempt to assert any claim through intimidation or force.
With China’s disregard to UN arbitration and international law’s UNCLOS by its illegal declaration of sovereignty to all of South China Sea with its unilateral attempts to assert its bogus 9-dash line claims through its show of intimidation or force in the Philippines and Vietnam, will the group of G-7 still remain silent to China’s military intentions or act on its mandate to oppose China’s actions now?
Since the problem is a state of unpreparedness – the lack of military capability of the AFP now, I believe that a viable alternative or contingency measure to the current sea dispute situation between China and the Philippines would be for the G-7 allies to provide the AFP with the necessary training and credible number of military hardware such as warships, missiles, fighter planes, and drones, on loans, to counter Chinese invasion of Philippine reefs and shoals. Well trained and credible armed Filipino soldiers have done their own fighting before against internal terrorists, in the Korean war and in WW2 and as first defenders before other nations will intervene, AFP will fight these Chinese invaders and outlaws again with a credible military hardware upgrade to protect its sovereignty and prevent further loss of more rich natural resource Philippine territories to China.
